Notwithstanding the retention of title clause appearing in paragraph 7 below, the customer bears the risks and perils of the goods from their dispatch. Unless otherwise stipulated in writing, the transport costs are the responsibility of the customer and the goods travel at his risk and peril. The transport of the goods will not be subject to any insurance unless expressly requested otherwise in writing by the customer in this regard. In this case, the insurance costs will be added to the amount owed by the customer.

WARM JACK cannot guarantee any given delivery date or guarantee that the goods will be available for delivery. If a product ordered is unavailable, WARM JACK will notify the customer in question as soon as possible and inform him of the earliest possible date of shipment. In this case, the customer will have the possibility of canceling his order in whole or in part. No cancellations will be accepted once the goods have been dispatched, but the goods may nevertheless be returned to sender under the provisions of paragraph 5 below.
